Definition

These Terms of Service govern the online store “LapinNoir.JP” (hereinafter referred to as the "Service") on this website, established by T-Ark Co., Ltd. These Terms of Service define the Terms of Service of use of the online store offered by the Company on the Website. Users are requested to use the Service in accordance with these Terms of Service. Sales Contract

In the Service, a purchase agreement shall be formed when a User makes an application for purchase to our Company and our Company notifies the User that the application has been accepted. Ownership of the product shall be transferred to the User when the Company delivers the product to the delivery carrier.

Prohibited Acts

While using the Service Users agree to refrain from the following

  • Disregarding any laws or regulations, these Terms of Service, warnings regarding using this Service, or warnings regarding making a purchase via this Service
  • Infringing upon the rights, interests, or reputation of this Company or a third party
  • Any actions that infringe on this Service or any third party's copyright, patent, trademark, trade secret or other intellectual property rights, including rights of publicity or privacy

  • Lending, transferring, or sharing a password with a third party
  • Fraudulently registering an email address or password and using this Service
  • Fraudulently registering a credit card or other form of electronic payment and using this Service
  • Take any action that is offensive to public order and morals
  • Violate any laws or perform any action that may lead to the violation of any laws
  • Provide false, inaccurate or misleading information (including personal information)
  • Utilize this Service for commercial gain without expressed authorization
  • Act in a manner that is defamatory, libelous, threatening or harassing
  • Take any action that detrimentally interferes with, surreptitiously intercepts or expropriates any system, data or Information; or interfere or attempt to interfere with the Service
  • Distribute viruses or any other technologies that may harm this Service, or the interests or property of other Users
  • Violate any domestic or international law, statute, ordinance, or regulations

  • Copyrights and other intellectual property rights to product photos and other content provided by the Service (hereinafter referred to as "Content") belong to the Company, Content providers, and other legitimate right holders, and Users may not reproduce, reprint, modify, or make any other secondary use of the Content without permission

Loss of User Privileges and Liability

Should a User commit any of the actions described “Prohibited Acts”, we may deem it appropriate to revoke their User privileges, at which point all agreements will be void, and all business dealings and correspondences will be suspended thenceforth. We reserve the right to restrict your use of all or part of the Service or terminate your user registration without prior notice in any of the following cases

  • If User refuses to accept these Terms of Service
  • When it is found that the User has committed any of the acts listed in the Prohibited Acts
  • If we determine that the level of trust necessary to conduct business cannot be created, improved, or maintained
  • If a User's name, address, telephone number, email address, or other information provided to us changes, but the User does not report the change
  • If any statement or information provided to us is under false pretense
  • If it is established that the individual has had their user privileges revoked due to violation of these Terms of Service
  • If the User interferes with the Service operation in any way
  • Cancellation of orders after shipment has been completed, intentional refusal to accept returns or packages due to non-payment of customs duties or other reasons, or any attempt to negotiate with us in such a manner
  • If payment or other obligations of debt are fulfilled late or are delinquent
  • If we are unable to contact the User via phone, email, or other means
  • If the User is otherwise found to have violated these Terms of Service
  • If we otherwise deem the User's action inappropriate
  • If a User commits any of the actions described below, the User shall bear financial responsibility for any and all damages we suffer from these actions
  1. Should account information or passwords be used for nefarious purposes
  2. Should our Service be accessed and information falsified, should a malicious computer program be sent to our Service, or any other action that disrupts business
  3. Should one infringe upon the intellectual property rights of our products
  4. Should the User do something that otherwise violates these Terms of Service

We assume no responsibility for damages, including damages to a third party, should a User lose their ability to use our Services due to our Company enforcing the measures set forth in this provision.

Changes to Terms of Service

The Company may change these Terms of Service at any time without notice to the User if it deems it necessary. In the event that a User starts using the Service after a change in the Terms of Service, such User shall be deemed to have agreed to the changed Terms of Service. We update the "Effective Date" at the top of the Terms of Service. You are advised to review these Terms of Service periodically for any changes. Changes to these Terms of Service are effective when they are posted on this page. The Company disavows any responsibility for inconvenience or loss caused to the User by updates to the Terms of Service.

Discontinuance, etc., of Provision of This Service

We reserve the right to suspend or discontinue all or part of the Service without prior notice to Users in the event of any of the following events. The Company shall not be liable for any disadvantage or damage incurred by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason

  • When performing maintenance, inspection, or updating of computer systems related to the Service
  • When it becomes difficult to provide this Service due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, etc.,
  • In the event of computer or telecommunication line failure due to an accident
  • In any other cases in which the Company deems it difficult to provide the Service

Regarding Minors Using Our Services

Our Services are not intended for persons under the age of 13 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and are aware that your child has provided us with personally identifiable information, we will not collect personally identifiable information from your child. Minors may only use our Service with the consent a parent or guardian. Any purchases made by a minor will be assumed to be under adult supervision.

Liability Indemnity

The Service accepts no liability for damages incurred by users or other third parties as a result of changes to or the suspension, discontinuation or abolishment of service. The Service accepts no liability for damages incurred to third parties by Users. In the event of such a situation said User accepts all responsibility, legal and financial, and agrees to not take any action which would interfere with or damage the Company in any way.

User Registration

"Users" refers to individuals who have followed the account registration procedure established by this Company, agreed to these Terms of Service, and registered for an account. "User Information" refers to information provided to this Company by Users for the purposes of account registration, or information pertaining to transactions by Users and the history of these transactions. These Terms of Service apply to all Users. Please abide by these Terms of Service when registering for an account and thereafter. The registration for this Service shall be completed when a prospective registrant agrees to these Terms of Service and applies for registration for use of the Service in the manner specified by the Company, and the Company notifies the prospective registrant of its approval of the application. If the Company determines that the applicant has any of the following reasons, the Company may not approve the application for registration, and shall not be obligated to disclose the reasons for such denial

User ID and Password Management

The User shall manage his/her User ID and password for the Service at his/her own responsibility. The User shall not, under any circumstances, transfer or lend his/her User ID and password to any third party, or share them with any third party. When a User logs in with the same combination of User ID and password as the registered information, the Company shall consider the use of the Service to be by the User who has registered the User ID. The Company shall not be liable for any damage caused by the use of a User ID and password by a third party, except in the case of willful misconduct or gross negligence on the part of the Company. Should you provide personal information to our Company, all data input and transferred will be protected by SSL encryption to ensure that the data is handled in a secure manner, meaning that all transmissions between your web browser and our server are encrypted and sent securely. However, as your email address and other information is transmitted via the internet, we cannot guarantee with absolute certainty that it will be safe. After receiving your information, we will do our best to ensure the security of our system. In the event that you are given a password to access a specific system on our website, it is your responsibility to keep this password confidential.

Creating Multiple Accounts

The Service limits one account per person. If you wish to change your account for some reason, please delete your existing account and create a new account again. Please note that points cannot be transferred.

Updates

Users will promptly contact us in the event that their name, address, or other information provided has changed. We refuse to take any responsibility for losses incurred due to failure to update information on file. Additionally, even in the event that registered information has been updated, any order processed prior to the change will be processed with the information on file prior to the change. We can accept a change of address for your purchased items if it has not been shipped. Please contact our Customer Support: support@t-ark.biz as soon as possible. We cannot accept a change of address if the items have already been shipped. Also, once an order has been shipped, all items are non-cancelable and no refunds will be given for any charges, including product price, shipping, and handling fees. If the User wishes to change his/her address after shipment, the User must notify the Shipping Company of the change of address himself/herself. Or, after the package is returned and arrives at our store, we will reship it after the User has paid the reshipment fee in full. We will contact you at your registered e-mail address as soon as the package arrives at our store; failure to pay the reshipment fee in full within 2 weeks will be considered a malicious cancellation of your order and all fees already paid, including the product price, shipping and handling, will not be refunded in any way. In such a case, please be aware that your contract with us may be permanently cancelled in the future in accordance with the Terms of Service.

If you cannot log in

If you have forgotten your password, please access the password reminder page through the "Forgot Your Password?" button on the log in page (Registered Customers). You can also contact us if you are still unable to log into your account. Please do not create a new account unless instructed to do so by our staff even if you cannot log into your account. Duplicate accounts will be closed.

Purchases

The Service may be used to purchase products. When placing orders with the Service, Users agree to read, agree with and accept our privacy policy as well as all of the Terms of Service contained in the User agreement. When placing an order, Users agree to adhere to the methods stipulated by the Service.

  • After placing and order, Users will receive an order confirmation notice from the Service
  • When placing an order, Users are entering a legal contract with this Service
  • This contract is binding until the products ordered have been delivered to the delivery carrier by the Company
  • This contact is subject to cancellation at any time at the discretion of the Service
  • Legal or other necessary measures will be taken if it has been determined at any time, including after an order has been completed, that the User has violated the Company's Terms of Service.

Our Products

International packages may have damage in transit. We will ship your collection in the most appropriate protective packaging. However, the outer box may be damaged during transport. In such cases, we will not be able to return or exchange the item. However, if there is obvious severe damage to the shipping box and package, you may be entitled to compensation from the shipping company. We may open and inspect the package prior to shipping to ensure that the item inside is not damaged. Please understand that this is done for safe shipping. Even if the product is new, it may be double-labeled upon inspection by the manufacturer. In addition, products that are more than 1 year old from the manufacturer's release date may show some age-related deterioration on the outer box and the figure itself inside, even if it is a new product. Please note that we cannot accept returns in such cases.

Prices

All prices are considered to be set at the time an order is placed. While we make every effort to provide accurate information, if a price error occurs, the price will be changed to the correct price, even if it is after the order has been placed. In the event of manufacturer price change any affected orders will be altered to reflect the new price.

Product Liability

In the event that a product cannot be procured, the Service reserves the right to cancel any orders as necessary. The Company will send products to the address stipulated by the user on the applicable order form. The Service will do its utmost to ensure the accuracy and completeness of product descriptions, however the Company accepts no liability for inaccuracies or errors. Current descriptions take precedence over those previous noted.

Payment

We may offer paid products and/or services on the Service. In such cases, we will use a third party service (e.g., a payment processing company) to process the payment. We do not store or collect your payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their privacy policies. These payment processors adhere to the PCI-DSS standards set forth by the PCI Security Standards Council, which is jointly administered by brands such as Visa, Mastercard, AmericanExpress, Diners, etc., The PCI-DSS requirements are designed to ensure the secure handling of payment information. This helps to ensure that Our partner payment companies are PayPal and stripe.

Refund Policy

If it is found to be our fault, we will issue a refund in accordance with the prescribed procedure. Both the merchandise and shipping charges will be converted from Japanese yen to the currency of the User’s choice and refunded at the exchange rate on the date of refund. Please note that the exchange rate may increase or decrease due to fluctuations in exchange rates. Please note that refund fees for credit card companies and PayPal are the responsibility of the User.

Cancellation Policy

Orders can be cancelled at any time prior to shipment. In case of cancellation, a handling fee of 5% of the total amount will be charged. The 5% will be deducted from the total price and refunded to the User. PayPal and credit card company fees are the responsibility of the User. Please include the following information

  • The name of the product you ordered
  • The order number
  • The date of purchase

Items that have already been shipped or paid for in installments cannot be cancelled. Installment payments will be automatically cancelled if no payment is made during the process and the stipulated payment date has passed. In such cases, installment payments cannot be rescheduled. In case of mid-cancellation, we will send you a message from us. We will send you an e-mail with instructions on how to choose between a refund of the amount paid so far minus a 15% handling fee, or a lump-sum payment of the remaining amount. Cancellations are permanent and cancelled items or orders cannot be reinstated. If you wish to purchase the cancelled item(s), please place a new order. If cancelled items are no longer available for sale, they cannot be resold under any circumstances. We reserve the right to restrict or close the accounts of any customer who abuses our Cancellation Policy or who abandons a shippable order without payment.

Shipping

All costs related to shipping service will be borne by the User. All shipping costs and applicable services will be determined by the company. The User agrees that the User, not us, will contact the local post office or delivery carrier regarding any changes in shipping address, etc., after the product has been shipped.

Compensation for damaged goods

Your collection will be shipped in the best possible protective packaging. International shipments can be damaged in transit, and while LapinNoir.JP will do its best to eliminate as much damage to the outer box as possible, we have no control over how your package is handled during transit. Therefore, the outer box may be damaged or scratched during transportation. Unfortunately, we cannot compensate for such damage. However, if the shipping box or package is obviously badly damaged, you may be entitled to compensation from the shipping company, so please contact our Customer Support: support@t-ark.biz within 2 days of receiving your package.

In the unlikely event that the product itself is damaged, we will arrange to resend a replacement product as compensation. So please contact our customer support: support@t-ark.biz within 2 days of receiving the product. If we are unable to arrange for a replacement product due to our inventory status, we will refund the product price, the initial shipping costs, and the return shipping costs to the customer.

However, please note that all handling fees are non-refundable. We will refund customs duties if the customer can provide us with proof of payment of customs duties. If our customer support team determines that we are at fault, we will accept the return of the product and reship a replacement upon receipt of the returned product. In such cases, we will bear all reshipment charges. The customer will be refunded the full amount of the cost (return shipping fee) incurred by the customer at the time of return. For this reason, please provide us with a receipt for the returned merchandise.

When contacting our customer support, please provide the following information

  1. A detailed description of the problem
  2. A photograph of the condition of the product immediately after arrival (a clear enlarged photo of the defective part)
  3. A clear photo of the paper invoice/delivery label/shipping company bag/shipping box taken alongside the item in question
  4. Order number

Conditions that are not covered by the compensation

  • Damage to the product's packaging or outer box is not considered damage to the product.
  • In addition, products that are more than 1 year old from the manufacturer's release date may show signs of age-related deterioration on the outer box and the figure itself inside, even if it is a new product (rust, odor, stickiness, paint migration, peeling paint, etc.). (Rust, odor, stickiness, paint migration, peeling paint, etc.) These are not eligible for returns or refunds and are not considered initial defects.
  • We cannot accept returns or refunds if the product you receive is not the same as the product image shown on the website. Since we often list products before the final product is released, most of the pictures shown are of prototypes or samples provided by the manufacturer. There may be slight differences between prototypes and actual mass-produced products. Also, some products require hand-painting at the factory, which may also cause individual differences. These are not considered manufacturer defects. In addition, small defects may be found in the paint or parts.   • Returns and refunds will not be accepted for any reason due to customs duties or other taxes in the country of delivery.
  • If a manufacturing defect in a product is clearly the result of abuse by the user, we reserve the right to reject the claim.

We will contact you with a solution as soon as possible. Please note that it may take us several days to reply. If the photos you send us do not include a shipping label or paper invoice, we will not be able to offer a solution to your claim. We are not responsible for damage limited to the exterior of the product.

All returns must be processed according to our customer support instructions. Unauthorized return of merchandise without notifying our customer support is not a legitimate return. Also, packages returned as undeliverable or unclaimed by the shipping company, or packages that the recipient refuses to accept for any reason, are not legitimate returns. As such, they are not eligible for all compensation, including refunds and exchanges, at our discretion. Furthermore, if a package is returned to the Company and the customer incurs return shipping charges, the customer is responsible for reimbursing the Company for the freight costs incurred in returning the package to the Company.

All returns must be sent back to us by shipping method with a tracking number. Returns sent without a tracking number will not be eligible for refunds, exchanges, or any other compensation at our discretion. In such cases, we will not be able to refund or replace the item.

If you suspect that there is something wrong with your Japan Post package

Please contact our customer support within 2 days of receiving the package.

  1. Take a picture of the package before opening it.
  2. If possible, open the package in the presence of the delivery staff. If the item inside is damaged, please submit a damage report (Damage Report) from the delivery staff. After signing the prescribed form and receiving a copy of the report, please send a scanned copy of the report to us. You may apply to Japan Post for insurance coverage.

If you believe there is something wrong with your package with DHL or FedEx

Please contact our customer support within 2 days of receipt of your package. Please include a photo that clearly shows both the damaged part and the invoice/label. We will contact the shipping company for compensation. Do not destroy the shipping documents (invoice and shipping label) until the problem is resolved.

Please note that we are unable to offer refunds/exchanges for items that are not insured and are damaged during shipping. For this reason, we strongly recommend EMS, DHL, and FedEx as shipping methods, especially for high value or fragile items.

Please contact us first rather than initiating a dispute with PayPal or filing a chargeback with your credit card company. While we will do our best to resolve any issues that arise, a PayPal dispute or chargeback will delay the process for a quick and amicable resolution.

Returns due to customer's own reasons

Returns, for any reason, must be reported within 15 days of receipt of goods. The Company will not provide service for reports received more than 15 days after the date of order acceptance. Users agree to follow the above procedures and to abide by the Company's Terms of Service.

Returnable condition (in case of return for customer's convenience)

  • Must be in new condition with all parts in place
  • Unopened and properly packaged, with no damage to the outer box
  • The Customer is responsible for all return shipping costs If the above conditions are met, we will accept the return and upon receipt of the returned merchandise, we will check the condition of the package and if there are no problems, we will refund the merchandise price only. However, we will not be able to refund the initial shipping fee, return shipping fee, various handling fees, or customs duties. If the merchandise is damaged at the time of return, the return will not be accepted and the merchandise price will not be refunded. Please pack your items carefully and securely to avoid damage when returning them.

All returns must be made in accordance with our return procedures. Packages returned as undeliverable or unclaimed by the shipping carrier or refused by the recipient for any reason are not legitimate returns. As such, they may not be eligible for refund or exchange at our discretion. Packages returned as undeliverable or unclaimed by the shipping company, or refused by the recipient for any reason, will never be compensated for the product price or shipping charges. If a package is returned to us and a return shipping charge is incurred, you are responsible for reimbursing us for the freight cost of the return.

When an item is returned to our store/ If you refuse to receive

Your package may be returned to our store due to reasons such as refusal to receive or incomplete address. Customers whose parcels are returned to our store will be notified of the reshipment to their registered email address. The full amount of the reshipment fee (Shipping charge for reshipment + Shipping charges incurred when the item is returned to us + Duties incurred on initial shipment) must be paid within 2 weeks after our store sends the email. We will reship the package after it arrives at our store and the customer has paid the reshipment fee in full.

  • Cancellation is not allowed after the product has been shipped. In addition, we will not refund the product price, shipping and handling charges for the initial shipment, customs duties, etc.
  • All shipping costs for reshipment are the responsibility of the customer.
  • Please note that for items shipped via FedEx or DHL, you may be charged additional shipping fees when returning the item to Japan.

In the unlikely event that the full amount of the reshipment fee is not paid within 2 weeks, the order will be cancelled as a malicious order and no refund will be made for the amount already paid, including the product price, shipping and handling charges. Please note that in this case, any future contracts with us may be permanently terminated in accordance with our Terms of Service.

Packages returned by the shipping company as undeliverable or unclaimed, or refused by the recipient for any reason, are not legitimate returns. As such, they may not be eligible for a refund at our discretion. Packages returned as undeliverable or unclaimed by the shipping company, or refused by the recipient for any reason, will never be compensated for shipping charges. If freight charges are incurred when a package is returned to us, you are responsible for reimbursing us for such charges.

Please contact us first rather than initiating a dispute with PayPal or filing a chargeback with your Credit Card company. While we will do our best to resolve any issues that arise, a PayPal dispute or chargeback will delay the process for a quick and amicable resolution.

About Change of Address & Reshipment

  • If there is a change in the name, address, or other registered information of the consignee, please contact us as soon as possible. If your purchased items have not been shipped, we will be happy to change your address. Please contact our Customer Support at support@t-ark.biz as soon as possible.
  • We cannot accept a change of address if the merchandise has already been shipped. In addition, once merchandise has been shipped, all orders are non-cancelable, and no refunds will be made for any charges, including but not limited to merchandise, shipping, and handling fees.
  • If the customer wishes to change his/her address after the product has been shipped, the customer must notify the shipping company himself/herself. Alternatively, we will reship the package after it arrives at our store and the customer has paid the reshipment fee (Shipping charge for reshipment + Shipping charges incurred when the item is returned to us + Duties incurred on initial shipment). Customers whose parcels are returned to our store will be notified of the reshipment to their registered email address. The full amount of the reshipment fee (Shipping charge for reshipment + Shipping charges incurred when the item is returned to us + Duties incurred on initial shipment) in full. For items shipped via FedEx or DHL, please note that you may be charged an additional shipping fee for returning the package to Japan. As with re-shipment, we cannot cover the shipping costs for re-shipment, and all costs are the responsibility of the customer. You will receive an email from us when your package arrives at our office. If the full amount of the reshipment fee is not paid within 2 weeks thereafter, the order will be cancelled as a malicious order and all payments already made will not be refunded, including the product price, shipping and handling charges. Please note that in this case, any future contract with us may be permanently cancelled in accordance with our Terms of Service.
  • We are not responsible for any damages caused by failure to notify us of address changes. Even if your registration information has been updated, orders processed prior to the change will be processed using your registration information as it existed prior to the change.
  • We can only change the shipping address for orders that have already been placed and have not yet been shipped. So, it will not apply to future orders. You will need to change the registered address of your account in advance in order to reflect this in future orders. Even if you give us your new address, we will not be able to change the address on your account. Please make sure to change the address listed in your account information by yourself.

Information Published on the Service

There is no guarantee regarding the accuracy, timeliness or usability of the information published on the Service. The Service reserves the right to add, alter, remove any information provided at any time and without prior notice.
